Terms of Service

These Terms of Service ("Terms") are a binding agreement between you and Pros Club, the international community brand that operates Pros ClubPeople Club and its sister chapters in other cities ("we", "us", "our", "Pros Club"). By creating an account, verifying your phone number, scanning a Pros Club QR code, joining any Pros Club chat or group, or otherwise using joinprosclub.comor any related app, chat, or event (together, the "Service"), you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service.

1. What Pros Club is, and how it works

Pros Club is the Pros Club chapter of Pros Club — the same brand, the same product, and the same rules apply at every chapter, wherever it is on the map. It is a community platform for people living in, working from, or visiting Pros Club. It runs entirely on joinprosclub.com. In plain terms, here is what the Service actually does:

The Service is free to join today. It is provided by the team behind Pros Club — a small group of long-term Pros Club residents and collaborators, not a large company with a call center or a legal department standing behind every message. Keep that in mind as you read the rest of these Terms: much of what follows exists specifically because a community like this — real people, real meetups, an AI that makes introductions — carries real risks we cannot control or insure against.

2. What the Service is NOT

You are responsible for using your own judgment about who you talk to, meet, or trust through the Service.

5. Community rules — prohibited conduct

You must not, on the Service or at any meetup or event connected to it:

  1. Harass, threaten, stalk, discriminate against, or send unwanted sexual attention to any member.
  2. Post or send hateful, violent, sexually explicit, or illegal content, including anything involving a minor — this is a zero-tolerance rule, immediate ban, and reported to the relevant authorities where required by law.
  3. Send spam, unsolicited promotions, crypto or MLM pitches, or run a commercial solicitation without our approval.
  4. Scam, defraud, or attempt to obtain money, credentials, or personal data from another member under false pretenses (including romance-scam or catfishing behavior).
  5. Share another member's phone number, photos, messages, or any personal information outside the Service without their consent.
  6. Create more than one account, impersonate someone else, or evade a ban or suspension.
  7. Use bots, scraping, or automated tools against the Service, or attempt to reverse-engineer, hack, or disrupt it.
  8. Use the Service for any activity illegal under United Statesn law or the law of your home country — including any immigration, work, or visa status you hold while in United States, which is entirely your own responsibility and never something the Service verifies or advises on.

We moderate the Service. We can remove content and warn, suspend, or permanently remove any member, at our sole discretion, with or without explanation.

6. Content you post

You keep ownership of the messages, photos, and profile content you post. By posting it, you give us a worldwide, royalty-free license to host, store, reproduce, display, and transmit it as needed to operate the Service (for example, showing your message to other members of your group, or your photo on your profile card and in Lucy's match cards).

You confirm you have the right to post whatever you post, and that it does not infringe anyone else's rights. We may remove any content, at any time, for any reason, including a report from another member or a legal request.

To report content or a member, tap their name to open their profile and use Report Something, or email info@joinprosclub.com with a description and, where relevant, a link or screenshot. We review every report and act within 24 hours, including removing content, warning, or banning the member responsible. You can also blockany member directly from their profile — this stops you messaging each other and removes you from each other's group member lists, immediately.

7. Copyright complaints

We respect intellectual property rights. If you believe content on the Service infringes your copyright, email info@joinprosclub.com with: (a) a description of the copyrighted work; (b) where the infringing material appears on the Service; (c) your contact information; (d) a statement that you have a good-faith belief the use is not authorized; and (e) a statement, made under penalty of perjury, that the information is accurate and you are authorized to act. We review valid notices, remove infringing content, and may terminate the account of a repeat infringer.

8. Lucy and other AI features

"Lucy" and similar assistants inside the Service are AI-powered, not a human. Lucy suggests introductions between members based on things like location and shared interests, but:

9. Sharing your phone number with other members

The Service lets a member ask to exchange WhatsApp numbers with another member. Sharing your number is entirely your own choice. Once you share it, we have no ability to control how that number is used, and no responsibility for what happens after — including unwanted contact, spam, or harassment from that member. Only share your number with people you trust, and report misuse to us immediately.

10. Meetups and events — hosted by members, at their own risk

Pros Club never organizes, hosts, sponsors, or supervises any meetup or event — not the dinners, surf sessions, beach days, or parties members post or talk about, and not any activity a group happens to be known for. Every meetup and event connected to the Service is created and run entirely by members, on their own initiative and their own judgment, whether or not we helped announce it.

Activities common in this community — including surfing, riding a scooter or motorbike, drinking alcohol, traveling in remote areas, and travel around Pros Club and United States generally — carry an inherent risk of injury, illness, property loss, or death. By attending any meetup or event connected to the Service, or by meeting any other member in person, you voluntarily and knowingly assume all such risks.

To the maximum extent permitted by law, you release and forever discharge us and our team, moderators, and collaborators from any and all claims, demands, injuries, damages, actions, or causes of action arising out of your attendance at, or travel to and from, any meetup or event, or out of any interaction — online or in person — with another member. This release does not apply where the law does not allow it (for example, our own gross negligence or willful misconduct where that cannot be released).

Use common sense, trust your instincts, and tell someone your plans when meeting people you don't know well.

11. No professional advice; no guaranteed outcomes

Anything shared in the Service by members or Lucy — including medical, legal, immigration, business, or travel information — is not professional advice. Always verify important information independently (for medical matters, see a licensed doctor; for legal or visa matters, see a licensed professional). We do not guarantee that using the Service will result in you making friends, finding a match, being admitted to a particular group, or having any particular experience.

12. Points, levels, referrals, and the leaderboard

Referral points, levels (Newcomer, Member, Connector, Ambassador), badges, and leaderboard rankings are for fun and community recognition only. They have no cash value, cannot be redeemed, transferred, or sold, and do not constitute a prize draw, lottery, or gambling scheme. We may change, reset, or discontinue this system at any time without liability.

13. Suspension and termination

You can stop using the Service and ask us to delete your account at any time — see our Privacy Policy. We may suspend or terminate your access to all or part of the Service, at any time, with or without notice and with or without cause, including if we believe you violated these Terms, created risk for another member, or created legal exposure for us. We may also modify, limit, or discontinue any part of the Service (including a specific group or feature) at any time.

14. Fees

The Service is free today. We may introduce paid features or subscriptions in the future; if we do, we will tell you clearly before you are charged anything, and using free features will remain free unless we say otherwise.

15. Third-party services

The Service relies on third parties we do not control, including Twilio (SMS login codes), an AI provider that powers Lucy, and our hosting and security providers. We are not responsible for the availability, content, or acts of these third parties, or for any other website, app, or business a member mentions or links to.

16. Intellectual property

The Pros Club and Pros Club names, logos, design, and software (excluding content posted by members) belong to us or our licensors. You may not copy, scrape, reverse-engineer, or create a competing product from the Service without our written permission. Any feedback or suggestion you send us about the Service may be used by us freely, without payment or attribution.

17. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any information shared by a member (including Lucy) is accurate or safe to rely on.

18. Limitation of liability

To the maximum extent permitted by law, we and our team, moderators, and collaborators will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, data, or goodwill, arising from your use of the Service. This includes, without limitation, any injury, illness, loss, theft, dispute, or death arising from a meetup, event, or interaction with another member, whether introduced through Lucy or otherwise.

Our total liability for any claim arising out of or relating to the Service will not exceed the greater of (a) the amount you paid us in the 12 months before the claim (which is USD 0 for a free account), or (b) USD 100.

Nothing in these Terms limits any liability that cannot be limited under applicable law (for example, liability for our own gross negligence, willful misconduct, or fraud, where the law does not allow it to be excluded).

19. Indemnification

You agree to defend, indemnify, and hold harmless us and our team, moderators, and collaborators from any claim, loss, liability, or expense (including reasonable legal fees) arising from: (a) your content; (b) your violation of these Terms; (c) your violation of any law or a third party's rights; or (d) your interaction with another member, online or in person, including at any meetup or event.

20. Governing law

These Terms, and any dispute about your account, your content, or your use of the Service, are governed by the law of the State of Texas, USA, without regard to conflict-of-law rules. This does not apply to a claim for personal injury, illness, property damage, or death arising from an in-person meetup or event, which may be brought under the law of the place where it happened, where applicable law requires that.

Nothing in this section removes any consumer-protection right you have under the mandatory law of your own country of residence that cannot be waived by agreement.

21. Resolving disputes — binding arbitration

Most issues can be solved directly. Contact us first at info@joinprosclub.com and give us 30 days to sort it out.

If that doesn't resolve it, you and Pros Club agree that any dispute arising from these Terms or the Service will be resolved by binding, individual arbitration, administered by the American Arbitration Association under its Consumer Arbitration Rules, seated in Texas, USA, conducted in English — instead of in court. Either party may instead bring a qualifying individual claim in small claims court, and we may seek injunctive relief in any court of competent jurisdiction to stop misuse of the Service or infringement of our rights.

You and Pros Club each waive the right to a jury trial and to participate in a class, consolidated, or representative action. If this arbitration agreement is found unenforceable as to a particular claim, that claim may be brought in the courts of Texas, USA instead, and the rest of this agreement still applies to every other claim.

22. Attorneys' fees

If either of us has to enforce these Terms against the other in arbitration or in court, the prevailing party is entitled to recover its reasonable attorneys' fees and costs, to the extent permitted by law.

23. Electronic communications

By using the Service you consent to receive communications from us electronically — on WhatsApp, by email, or inside the app — and agree that these satisfy any legal requirement that such communications be in writing.

To report abuse, a safety concern, a fake profile, or content involving a minor, email info@joinprosclub.com or message us on WhatsApp. We act on safety reports as a priority and, where the law requires it, we report illegal content or activity to the relevant authorities.
